Commitment to personal data protection<\/strong><\/p>\n

The protection of our runners’ personal data is important to us. A breach of data protection can lead to a loss of trust and put the organisation at risk. We therefore act in accordance with the European General Data Protection Regulation (GDPR) and the Federal Data Protection Act (DPA), insofar as the relevant provisions are applicable to individual cases.<\/p>\n

In addition to this data protection policy (https:\/\/www.ascona-locarno-run.ch\/data-protection<\/a>), as we have commissioned Datasport with the management of entries, time recording and\/or the provision of other services, we refer to their data protection regulations for these services https:\/\/www.datasport.com\/en\/privacy-statement\/<\/a>.<\/p>\n

Responsible persons, contact details<\/strong><\/p>\n

For the collection and processing of personal data in the context of the event, the Ascona-Locarno Run Association, Via San Giorgio 28, 6656 Golino, Switzerland is responsible (in particular pursuant to Article 4 para. 7 of the European Data Protection Ordinance (GDPR) and the Federal Data Protection Act (DPA), insofar as the respective provisions are applicable). Where the GDPR is applicable, the contact person within the meaning of Article 27 GDPR is Elio De Carli, Via San Giorgio 28, 6656 Golino, Switzerland.<\/p>\n

For registration and timekeeping, all runners must open an account with Datasport. The third-party timing company is responsible for processing the account data and the data protection declarations and general terms and conditions of the respective third-party company (https:\/\/www.datasport.com\/en\/privacy-statement\/<\/a>) apply.<\/p>\n

Outsourcing of data processing<\/strong><\/p>\n

In accordance with the law, we are obliged to monitor the data processing of companies that work on our behalf to organise and execute the event. It is therefore our duty to ensure that these companies do not process the data collected for their own purposes or pass it on to unauthorised third parties.<\/p>\n

Registration of data collection with the FDPIC<\/strong><\/p>\n

Our data collections are registered with the Federal Data Protection and Information Commissioner.<\/p>\n

Legal basis<\/strong><\/p>\n

The legal basis for the processing of personal data is Art. 6 para. 1 let. a GDPR or Art. 13 para. 1 DPA. If the data is processed for the performance of a contract with the data subject, including pre-contractual measures, the legal basis is Art. 6 para. 1 let. b GDPR or Art. 13 para. 2 let. a DPA. If the processing is necessary for the protection of a legitimate interest of our company or a third party, the legal basis for the processing is Art. 6 para. 1 let. f GDPR or Art. 13 para. 1 DPA. This applies, for example, to marketing, provided that you have not objected to your data being used for marketing purposes.<\/p>\n

Data processing for the current event<\/strong><\/p>\n

Only the surname, first name, year of birth, gender, private address, e-mail address and mobile phone number of the runners are required for registration and the running of the race. Further data are collected only on a voluntary basis and only if it is necessary for the provision of further services in connection with the event. We process these data for the purpose of running the event including the delivery of information about your participation and starting documents (digital starting package), as well as a request for feedback after the race. The processing takes place for the execution of the contract you have concluded with us and on the basis of an overriding interest on our part.<\/p>\n

Creation and publication of start lists and rankings<\/strong><\/p>\n

First name, surname, year of birth, gender, place of residence, category and race time will be published in rankings. The full address or other information not required for drawing up the rankings will not be published.
\nThe times are recorded at various passage points and electronically assigned to the runner via a transponder. If necessary, this data will be published during and after the event on the organiser’s website and in the press. The rankings will be published on the organiser’s website and on the Datasport website and integrated into the list of Switzerland’s top athletics specialists.
\nThe publication of the data serves the purpose of comparison between the participants at ranking level. The runner may request that six months after the end of the event his name be removed from the list of results available to the public.
\nThe processing of data and the creation and publication of rankings fulfil the contractual obligations entered into by the participant following registration and between the participant and the organiser. The publication of ranking data after six months is based on the predominant self-interest of the organiser.<\/p>\n

Data processing for own marketing<\/strong><\/p>\n

We may use your information to provide you with information about other events.
\nBy subscribing to our newsletter, you explicitly and legally authorise us to send you and agree to receive e-mails and other electronic notifications containing advertising information (hereinafter referred to as “newsletter”). The receipt of our newsletter can be cancelled at any time, i.e. the consent can be revoked, the link to proceed with the cancellation can be found at the bottom of each newsletter.
\nThe newsletter of the Ascona-Locarno Run contains information about our services, products and events, in addition to the possibility to subscribe, it may also contain information of third-party partners. The subscription to our newsletter takes place according to the so-called “double opt-in” procedure. This means that after registration you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that nobody can log in with other e-mail addresses.
\nThose who sign up for the competitions will be implicitly subscribed to the newsletter. For those who only wish to subscribe to the newsletter, simply enter your e-mail address in the web form provided. Optionally, we ask you to indicate your surname, first name, gender, date of birth so that we can personally address the newsletter to you.
\nThe newsletter is sent by the mail service provider “MailChimp”, a platform for sending newsletters of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. The privacy policy of the mailing provider can be viewed here: mailchimp.com\/legal\/privacy\/. Rocket Science Group LLC d\/b\/a MailChimp is certified under the Privacy Protection Agreement and thus offers a guarantee of compliance with the European data protection level (https:\/\/www.privacyshield.gov\/participant?id=a2zt0000000TO6hAAG&status=Active<\/a>).
\nThe newsletter service provider is used on the basis of our legitimate interests pursuant to Art.6 para. 1 lit. f GDPR and an order processing agreement pursuant to Art. 28 para. 3 S. 1 GDPR. The newsletter service provider may use the recipient’s data anonymously, i.e. without allocation to a user, to optimise or improve its services, e.g. to technically optimise the sending and presentation of the newsletter or for statistical purposes. However, the dispatch service does not use the data of the recipients of our newsletter for its own purposes or to pass them on to third parties.<\/p>\n

Processing, storage and proportionality of data collection<\/strong><\/p>\n

We only collect and process the amount of data that is absolutely necessary for the intended purpose. We store your data for the duration of the statutory limitation period (usually 10 years).
\nWe delete data that is no longer required, unless there are legal retention obligations or the data is retained on the basis of another legal basis or an overriding self-interest.
\nIf you have subscribed to the newsletter and if you unsubscribe, we may, on the basis of our legitimate interests and in order to prove the consent previously given, retain stored but not used the unsubscribed e-mail addresses with the attached consent for the legal period of limitation.
\nThe processing of this data is limited to the purpose of a possible defence against claims. An individual request for cancellation can be made at any time, provided that the prior existence of consent is confirmed at the same time.<\/p>\n

Disclosure of data to third parties<\/strong><\/p>\n

We only pass on personal data to third-party partners who contractually undertake to process the data only for a specific and clearly defined purpose and not to pass it on to unauthorised third parties (see list of authorised partners).
\nThe law requires that in order to pass on data to third-party partners for the purpose of providing their services on the basis of a contract with the organiser (photo services, competitions\/contests, timekeeping, newspapers, TV stations, Internet services, partner offers, etc.), the runner must give his or her informed consent when registering.
\nIn accordance with the Data Protection Act, the runner consents and authorises the disclosure of his personal data: surname and first name, private address (street, postcode and town), date of birth, gender, telephone number and e-mail address to partners on condition that the runner does not explicitly prohibit the disclosure of this data by notification to the postal or e-mail address given below: privacy@ascona-locarno-run.ch. These partners may use the data for their own services or for advertising purposes and, in the case of sponsors, for specific purposes and campaigns in connection with the current event.
\nYou may revoke your consent to the transfer of data to third parties at any time.<\/p>\n

Rights of the participant<\/strong><\/p>\n

The participant has the right to request information about the data concerning him\/her that are being processed. He also has the right to request the rectification, deletion or restriction of the processing of his data and, where applicable, the right to the transferability of his data. The participant may also object to the use of his data for marketing purposes.
\nThese rights exist to the extent that there are no legal retention obligations or other legitimate interests in conflict with the request. The participant also has the right to appeal to the competent data protection supervisory authority.
\nConsent to the processing of data may be revoked at any time if the overriding interest is considered, by making an explicit request by means of a registered letter to the address: Associazione Ascona-Locarno Run, Via San Giorgio 28, 6656 Golino, Switzerland.<\/p>\n

Data integrity<\/strong><\/p>\n

We take appropriate technical and organisational measures to protect the data of our runners, in particular against intentional or accidental destruction or falsification and against access by unauthorised third parties. If data is processed by an outsourcing partner such as Datasport, we ensure that it processes the data in accordance with legally required data security requirements, and these are constantly monitored in accordance with best practice and standards.<\/p>\n

Web analytics services<\/strong><\/p>\n

In order to analyse our ranking on search engines and improve our performance in order to reach more people, we use web analytics services such as “Google Analytics”. We do not provide Google Analytics with any sensitive data, and we only receive data about the use of the website from Google Analytics. The headquarters and servers of “Google Analytics” (a service provided by Google Inc.) are located in the USA.<\/p>\n

Updates to the information<\/strong><\/p>\n

The Ascona-Locarno Run Association reserves the right to make changes to this policy at any time and without prior notice. Any changes will be communicated via the newsletter; unless expressly stated otherwise made available to us within 30 days by the means described in the paragraph “Rights of the participant”, we will consider that you have taken note and accepted the content.<\/p>\n

Outsourcing der Datenverarbeitung<\/strong><\/p>\n

Nach dem Gesetz sind wir verpflichtet, die Datenverarbeitung der Unternehmen zu kontrollieren, die in unserem Auftrag oder in unserem Namen f\u00fcr die Organisation und Durchf\u00fchrung der Veranstaltung t\u00e4tig sind. Es ist daher unsere Pflicht sicherzustellen, dass diese Unternehmen die erhobenen Daten nicht f\u00fcr eigene Zwecke verarbeiten oder an unberechtigte Dritte weitergeben.<\/p>\n

Anmeldung der Datensammlung beim ED\u00d6B<\/strong><\/p>\n

Unsere Datensammlungen sind beim Bundesdatenschutz- und Informationsbeauftragten registriert.<\/p>\n

Rechtsgrundlage<\/strong><\/p>\n

Rechtsgrundlage f\u00fcr die Verarbeitung personenbezogener Daten ist Art. 6 Abs. 1 lit. a GDPR bzw. Art. 13 Abs. 1 DSGVO. Erfolgt die Verarbeitung der Daten zur Erf\u00fcllung eines Vertrages mit der betroffenen Person, einschlie\u00dflich vorvertraglicher Ma\u00dfnahmen, ist die Rechtsgrundlage Art. 6 Abs. 1 Buchstabe b DSGVO bzw. Art. 13 Abs. 2 Buchstabe a DSGVO. Ist die Verarbeitung zur Wahrung eines berechtigten Interesses unseres Unternehmens oder eines Dritten erforderlich, so ist die Rechtsgrundlage f\u00fcr die Verarbeitung Art. 6 Abs. 1 lit. f DSGVO oder Art. 13 Abs. 1 DSGVO. Datenverarbeitung f\u00fcr das aktuelle Ereignis<\/strong><\/p>\n

F\u00fcr die Anmeldung und die Durchf\u00fchrung des Rennens werden nur Name, Vorname, Geburtsjahr, Geschlecht, Privatanschrift, E-Mail-Adresse und Mobiltelefonnummer der L\u00e4ufer ben\u00f6tigt. Weitergehende Daten werden nur auf freiwilliger Basis und nur dann erhoben, wenn sie f\u00fcr die Erbringung weiterer Dienstleistungen im Zusammenhang mit der Veranstaltung oder im Zusammenhang mit der Veranstaltung erforderlich sind. Wir verarbeiten diese Daten zum Zweck der Durchf\u00fchrung der Veranstaltung, einschlie\u00dflich der Zustellung von Informationen \u00fcber Ihre Teilnahme und Startunterlagen (digitales Startpaket), sowie der Bitte um Feedback nach dem Rennen. Die Verarbeitung erfolgt zur Erf\u00fcllung des Vertrages, den Sie mit uns geschlossen haben, und auf der Grundlage eines \u00fcberwiegenden Interesses unsererseits.<\/p>\n

Erstellung und Ver\u00f6ffentlichung von Startlisten und Ranglisten<\/strong><\/p>\n

Vorname, Nachname, Geburtsjahr, Geschlecht, Wohnort, Kategorie und Rennzeit werden in den Ranglisten ver\u00f6ffentlicht. Die vollst\u00e4ndige Adresse oder andere Informationen, die nicht f\u00fcr die Erstellung des Rankings notwendig sind, werden nicht ver\u00f6ffentlicht.
\nDabei werden die Zeiten an verschiedenen \u00dcbergabestellen erfasst und \u00fcber einen Transponder elektronisch dem L\u00e4ufer zugeordnet. Werden diese Daten w\u00e4hrend und nach der Veranstaltung auf der Website des Veranstalters sowie in der Presse ver\u00f6ffentlicht. Die Ranglisten werden auf der Website des Veranstalters und auf der Datasport-Website publiziert und in die Liste der besten Leichtathletik-Spezialisten der Schweiz integriert.
\nDie Ver\u00f6ffentlichung der Daten dient dem Vergleich zwischen den Teilnehmern auf Ranglistenebene. Der L\u00e4ufer kann sechs Monate nach Ende der Veranstaltung verlangen, dass sein Name aus der \u00f6ffentlich zug\u00e4nglichen Ergebnisliste entfernt wird.
\nMit der Verarbeitung der Daten und der Erstellung und Ver\u00f6ffentlichung der Ranglisten werden die vom Teilnehmer nach der Anmeldung eingegangenen vertraglichen Verpflichtungen zwischen dem Teilnehmer und dem Veranstalter erf\u00fcllt. Die Ver\u00f6ffentlichung von Ranglistendaten nach sechs Monaten beruht auf dem \u00fcberwiegenden Eigeninteresse des Veranstalters.<\/p>\n

Datenverarbeitung f\u00fcr Ihr eigenes Marketing<\/strong><\/p>\n

Wir k\u00f6nnen Ihre Daten verwenden, um Sie mit Informationen \u00fcber andere Veranstaltungen zu versorgen.
\nMit dem Abonnement unseres Newsletters erm\u00e4chtigen Sie uns ausdr\u00fccklich und rechtsverbindlich zum Versand von E-Mails und anderen elektronischen Benachrichtigungen mit werblichen Informationen (nachfolgend “Newsletter” genannt) und stimmen diesem zu. Der Empfang unseres Newsletters kann jederzeit abbestellt werden, d.h. die Einwilligung kann widerrufen werden, der Link zum Abbestellen befindet sich am Ende eines jeden Newsletters.

Wir erheben und verarbeiten nur so viele Daten, wie f\u00fcr den vorgesehenen Zweck unbedingt erforderlich sind. Wir speichern Ihre Daten f\u00fcr die Dauer der gesetzlichen Verj\u00e4hrungsfrist (in der Regel 10 Jahre).
\nWir l\u00f6schen Daten, die nicht mehr ben\u00f6tigt werden, es sei denn, es bestehen gesetzliche Aufbewahrungspflichten oder die Daten werden auf Grundlage einer anderen Rechtsgrundlage oder eines \u00fcberwiegenden Eigeninteresses aufbewahrt.

Weitergabe von Daten an Dritte<\/strong><\/p>\n

Wir geben personenbezogene Daten nur an Drittpartner weiter, die sich vertraglich verpflichten, die Daten nur f\u00fcr einen bestimmten und klar definierten Zweck zu verarbeiten und nicht an unberechtigte Dritte weiterzugeben (siehe Liste der autorisierten Partner).
\nDas Gesetz schreibt vor, dass f\u00fcr die Weitergabe von Daten an dritte Partner zum Zwecke der Erbringung ihrer Leistungen auf der Grundlage eines Vertrages mit dem Veranstalter (Fotodienste, Gewinnspiele, Zeitmessung, Zeitungen, TV-Sender, Internetdienste, Partnerangebote usw.) eine informierte Zustimmung des L\u00e4ufers bei der Anmeldung erforderlich ist.
\nGem\u00e4\u00df dem Datenschutzgesetz willigt der L\u00e4ufer ein und genehmigt die Weitergabe seiner pers\u00f6nlichen Daten: Name und Vorname, Privatanschrift (Stra\u00dfe, Postleitzahl und Ort), Geburtsdatum, Geschlecht, Telefonnummer und E-Mail-Adresse an Partner unter der Bedingung, dass der L\u00e4ufer die Weitergabe der Daten nicht ausdr\u00fccklich durch Mitteilung an die unten angegebene Post- oder E-Mail-Adresse privacy@ascona-locarno-run.ch untersagt. Solo il cognome, nome, anno di nascita, genere, indirizzo privato, indirizzo e-mail e numero di cellulare dei corridori sono obbligatori per la registrazione e lo svolgimento della gara. Ulteriori dati vengono raccolti solo su base volontaria e solo se necessari per la fornitura di ulteriori servizi correlati alla manifestazione o a corollario della stessa. Elaboriamo questi dati per lo svolgimento dell\u2019evento, tra cui la consegna di informazioni sulla vostra partecipazione e i documenti di partenza (pacchetto di partenza digitale), nonch\u00e9 una richiesta di feedback dopo la gara. Il trattamento avviene per l’esecuzione del contratto da Lei stipulato con noi e sulla base di un interesse preponderante da parte nostra.<\/p>\n

Creazione e pubblicazione di liste di partenza e di graduatorie<\/strong><\/p>\n

Il nome, il cognome, l’anno di nascita, il genere, il luogo di residenza, la categoria e il tempo di gara saranno pubblicati nelle classifiche. Non saranno pubblicati l’indirizzo completo o altre informazioni non necessarie alla stesura delle classifiche.
\nI tempi vengono registrati in diversi punti di passaggio e assegnati elettronicamente al corridore tramite un transponder. Se necessario, questi dati saranno pubblicati durante e dopo l’evento sul sito Internet dell\u2019organizzatore, nonch\u00e9, sulla stampa. Le classifiche saranno pubblicate sul sito web dell’organizzatore e sul sito di Datasport e integrate nella lista dei migliori specialisti di atletica leggera della Svizzera.
\nLa pubblicazione dei dati serve al confronto tra i partecipanti a livello di classifica. Il corridore pu\u00f2 richiedere che dopo sei mesi dalla fine dell’evento il suo nome venga rimosso dall’elenco dei risultati disponibile al pubblico.
\nL’elaborazione dei dati, la creazione e la pubblicazione delle classifiche adempiono agli obblighi contrattuali assunti dal partecipante a seguito dell\u2019iscrizione e che intercorrono tra partecipante e organizzatore. La pubblicazione dei dati su una graduatoria dopo sei mesi si basa su un interesse proprio predominante dell’organizzatore.<\/p>\n

Elaborazione dei dati per il proprio marketing<\/strong><\/p>\n

Possiamo utilizzare le vostre informazioni per fornirvi informazioni su altri eventi.

D’autres donn\u00e9es ne sont collect\u00e9es que sur une base volontaire et uniquement si elles sont n\u00e9cessaires \u00e0 la fourniture d’autres services en rapport avec l’\u00e9v\u00e9nement ou en rapport avec l’\u00e9v\u00e9nement. Nous traitons ces donn\u00e9es dans le but d’organiser l’\u00e9v\u00e9nement, y compris la livraison d’informations sur votre participation et de documents de d\u00e9part (paquet de d\u00e9part num\u00e9rique), ainsi qu’une demande de feedback apr\u00e8s la course. L’adresse compl\u00e8te ou toute autre information non n\u00e9cessaire \u00e0 la pr\u00e9paration du classement ne sera pas publi\u00e9e.
\nLes temps sont enregistr\u00e9s \u00e0 diff\u00e9rents points de passage et attribu\u00e9s \u00e9lectroniquement au coureur via un transpondeur. Si n\u00e9cessaire, ces donn\u00e9es seront publi\u00e9es pendant et apr\u00e8s l’\u00e9v\u00e9nement sur le site web de l’organisateur ainsi que dans la presse. Les classements seront publi\u00e9s sur le site de l’organisateur et sur le site de Datasport et int\u00e9gr\u00e9s dans la liste des meilleurs sp\u00e9cialistes suisses de l’athl\u00e9tisme.
\nLa publication des donn\u00e9es sert \u00e0 la comparaison entre les participants au niveau du classement. Le coureur peut demander que, six mois apr\u00e8s la fin de l’\u00e9preuve, son nom soit retir\u00e9 de la liste des r\u00e9sultats mise \u00e0 la disposition du public.
\nLe traitement des donn\u00e9es, la cr\u00e9ation et la publication des classements r\u00e9pondent aux obligations contractuelles contract\u00e9es par le participant apr\u00e8s son inscription et entre le participant et l’organisateur. La publication des donn\u00e9es de classement apr\u00e8s six mois est bas\u00e9e sur l’int\u00e9r\u00eat personnel pr\u00e9dominant de l’organisateur.<\/p>\n
